Partial Rent Payments: How to Accept and Record Them (Free Agreement)

A partial rent payment is when a tenant pays only part of the rent that is due. You can usually choose to accept it or not, but if you accept, put the plan in writing, give a receipt that shows the balance, and record each payment on its own ledger line. Be careful if you have already served a notice, because in some states taking money can affect an eviction.

What is a partial rent payment?

Say rent is $1,400 and the tenant pays $900 on the 3rd and promises the rest by the 15th. That $900 is a partial payment, and $500 is still owed. It happens most after a job change, a medical bill or a late paycheck.

Should you accept partial rent?

Accepting can helpAccepting can hurt
You get some cash now instead of nothing. In some states it can affect a notice or an eviction you already started.
It keeps a good tenant in place through a short rough patch.Without a written plan, the balance can drag on for months.
It shows good faith if the case ever reaches court. If you accept it from one tenant and refuse another, it can look unfair.

A simple rule many small landlords use: accept a partial payment only with a short written plan for the balance, and never during an eviction without advice from a local attorney.

State cautions: Florida and California

StateWhat to knowSource
FloridaAccepting partial rent is not, by itself, a waiver. But if a landlord accepts partial rent after posting a nonpayment notice, the landlord must either give a receipt showing the date, amount, agreed date and balance, deposit the money with the court when filing, or post a new 3 day notice for the new amount.Florida Statutes 83.56(5)(a)
CaliforniaA tenant can use waiver by acceptance of rent as a defense if the landlord accepts rent, even part of it, after the 3 day notice period ends. A lease clause and a clear written objection can help, but get advice first.CACI No. 4324

Other states have their own rules. If you are not sure, treat any money you receive after a notice as a legal question, not just a bookkeeping one.

Keep it short and specific. Here is an example you can adapt:

Partial Payment Agreement
Tenant: Maria Lopez
Rental: 418 Oak Street, Unit 2, Austin, TX 78704
October 2026 rent: $1,400.00
Paid on 10/03/2026: $900.00 (cash)
Balance: $500.00, due by 10/15/2026

Accepting this partial payment does not change the lease or waive any of the landlord’s rights under it. If the balance is not paid by 10/15/2026, the lease terms for late rent apply.

If your lease has a late fee and part of the rent is still unpaid after the grace period, add the fee as its own charge line. Our late rent fee guide shows how, and the tenant ledger template builds the full history for one tenant.

What should the receipt say?

  • The date you received the money and the amount.
  • The rent period it applies to, for example October 2026.
  • How it was paid: cash, check number, Zelle or money order.
  • The balance still owed and the date it is due.
  • Your name and signature.

Our free rent receipt template has all of these fields, including a Balance still owed line.

Note: Rules on partial payments, notices and evictions vary by state and city. Check your local rules or ask a local attorney, especially if you have already served a notice.

If the rest of the rent does not arrive, see our late rent notice guide for the next step.

Florida landlords: if you accept partial rent after a 3 day notice, follow one of the three steps in the table above, or you may waive the notice. See our Florida landlord guide.

Frequently asked questions

Can a landlord refuse a partial rent payment?

In most states a landlord can choose whether to accept a partial payment, unless the lease, a local rule or a housing program says otherwise. If you have already served a notice or started an eviction, ask a local attorney before you take any money.

Can a landlord still evict after accepting a partial rent payment?

Sometimes not, depending on your state and timing. In California, accepting rent after a notice period ends can be used by the tenant as a defense, and in Florida a landlord who accepts partial rent after a notice must follow specific steps. Get local advice before accepting money during an eviction.

Should I give a receipt for a partial payment?

Yes. The receipt should show the amount received, the date, the rent period and the balance still owed. Our free rent receipt template has a Balance still owed line for this.

Can I charge a late fee when only part of the rent is paid?

If your lease allows it and part of the rent is still unpaid after the grace period, a late fee may apply, subject to your state rules. Texas, for example, allows the fee once any part of the rent is unpaid two full days after the due date. See our late rent fee guide.

How do I show several partial payments in a ledger?

Give each payment its own line with the date, amount and method. The running balance then shows exactly what is still owed after each payment.
