What is a rent payment plan?
A rent payment plan spreads money a tenant already owes over the next few weeks or months. The tenant keeps paying the regular rent each month and adds a set payment toward the old balance until it reaches $0.
It is different from a single partial rent payment, where a tenant pays part of one month’s rent and the rest a few days later. A payment plan is for a bigger balance, often a full month or more, that needs several payments to clear.
When does a payment plan make sense?
| A plan often works when | Think twice when |
|---|---|
| The tenant has a good payment history and hit a short setback (a job change, a medical bill, a car repair). | The tenant has missed rent several times and past plans were not kept. |
| The tenant can show how they will pay (a new job, a tax refund, help from a program). | The tenant cannot say where the money will come from. |
| The balance can be paid off in a few months. | The plan would run so long that the balance keeps growing. |
| You would rather keep a good tenant than face a vacancy. | You already served a notice or filed for eviction (see the warning below). |
Many small landlords offer the same kind of plan to any tenant in the same situation. Treating tenants the same way keeps things fair and easy to explain.
What to include in the agreement
- Who and where: landlord, every adult tenant on the lease, and the rental address and unit.
- The past due amount and exactly what it covers, for example December 2026 rent $1,250.00 and a $75.00 late fee.
- The schedule: each payment’s due date and amount. The payments should add up to the past due total.
- Regular rent stays due: the tenant still pays each new month’s rent in full and on time.
- What happens if a payment is missed: for example, the plan ends, the remaining balance is due and the lease terms for unpaid rent apply.
- Late fees: whether new late fees apply to plan payments. Only charge what your lease and state law allow.
- No change to the lease: a line saying the agreement does not change the lease or waive your rights under it, except as written.
- Signatures and dates from you and every adult tenant, with a copy for each person.
Example: a 3 payment plan
Denise Carter rents 2214 Pecan Lane, Unit B, San Antonio, TX 78210 for $1,250.00 a month, due on the 1st. She lost two weeks of work in December and paid nothing that month. Her lease has a $75.00 late fee, so on 01/05/2027 she owes $1,325.00. She can pay the January rent on time and about $440 extra a month.
| Payment | Due date | Amount |
|---|---|---|
| 1 | 01/15/2027 | $445.00 |
| 2 | 02/15/2027 | $440.00 |
| 3 | 03/15/2027 | $440.00 |
| Total | $1,325.00 |
Here is how the main part of the signed agreement reads:
Rent Payment Plan Agreement
Landlord: Robert Hayes
Tenant: Denise Carter
Rental: 2214 Pecan Lane, Unit B, San Antonio, TX 78210
Monthly rent: $1,250.00, due on the 1st
Past due today: $1,325.00 (December 2026 rent $1,250.00 and late fee $75.00)
Schedule: $445.00 by 01/15/2027, $440.00 by 02/15/2027, $440.00 by 03/15/2027
The tenant will also pay each regular month’s rent in full and on time. If any plan payment or regular rent is not paid in full by its due date, this plan ends, the remaining balance is due, and the lease terms for unpaid rent apply, unless the landlord agrees otherwise in writing. This agreement does not change the lease or waive any of the landlord’s rights under it, except as written here. No new late fees apply to plan payments made on time.

How to record plan payments in your ledger
Keep the old balance and the new rent on the same running balance. Give every charge and every payment its own line, and never change the rent line itself.
| Date | Description | Charge | Payment | Balance |
|---|---|---|---|---|
| 12/01/2026 | December rent | $1,250.00 | $1,250.00 | |
| 12/04/2026 | Late fee (per lease) | $75.00 | $1,325.00 | |
| 01/01/2027 | January rent | $1,250.00 | $2,575.00 | |
| 01/01/2027 | Payment, ACH (January rent) | $1,250.00 | $1,325.00 | |
| 01/15/2027 | Plan payment 1 of 3, Zelle (receipt 0211) | $445.00 | $880.00 | |
| 02/01/2027 | February rent | $1,250.00 | $2,130.00 | |
| 02/01/2027 | Payment, ACH (February rent) | $1,250.00 | $880.00 | |
| 02/15/2027 | Plan payment 2 of 3, check 1047 | $440.00 | $440.00 | |
| 03/01/2027 | March rent | $1,250.00 | $1,690.00 | |
| 03/01/2027 | Payment, ACH (March rent) | $1,250.00 | $440.00 | |
| 03/15/2027 | Plan payment 3 of 3, money order | $440.00 | $0.00 |
Write “plan payment 1 of 3” in the description so anyone reading the ledger later can match it to the signed agreement. Give a receipt for every payment that shows the balance still owed. Our free rent receipt template has a Balance still owed line, and the tenant ledger template keeps the full history for one tenant.
What if the tenant misses a plan payment?
- Follow what you both signed. If the agreement says the plan ends and the balance is due, say so in writing. Do not change the deal by text or phone without a new signed page.
- Send a written reminder. Our late rent notice is a friendly reminder with the amount owed and a pay by date. It is not an eviction notice.
- Talk before you act. If the tenant is close and has paid the rest, a new short plan may still be better than a vacancy. Put any new plan in writing.
- Know your next step. Eviction notices follow your state’s rules and forms. If you go that way, check your state law or ask a local attorney first.
Already served a notice? Read this first
In some states, taking money after you serve a notice for unpaid rent can affect that notice or an eviction case. Two examples:
| State | What to know | Source |
|---|---|---|
| Florida | If a landlord accepts partial rent after posting a nonpayment notice, the landlord must either give a receipt showing the date, amount, agreed date and balance, deposit the money with the court when filing, or post a new 3 day notice for the new amount. | Florida Statutes 83.56(5)(a) |
| California | A tenant can use waiver by acceptance of rent as a defense if the landlord accepts rent, even part of it, after the 3 day notice period ends. | CACI No. 4324 |
Other states have their own rules. If you already served a notice or filed a case, treat a payment plan as a legal question and ask a local attorney before you accept any money.
Where tenants can look for rent help
A plan works best when the tenant has a real way to pay. You can point tenants to these free resources:
- 211: the 211 network says your local 211 is the best resource for finding options to pay rent and utility bills. Tenants can call 211 or visit 211.org.
- CFPB renter help: the Consumer Financial Protection Bureau keeps a page that points renters to local programs and HUD housing counselors: consumerfinance.gov/renthelp.
- Section 8 tenants: if a tenant with a housing voucher lost income, they can ask the housing authority to recalculate their share of the rent (an interim reexamination, 24 CFR 982.516(c)). See our Section 8 rent ledger for how to track both portions.
Rules on late fees, payments after a notice and evictions differ by state and city. Check your lease and local law, or ask a local attorney, especially if you already served a notice.
Frequently asked questions
Does a landlord have to offer a rent payment plan?
In most places a landlord can choose whether to offer one, unless the lease, a local rule or a housing program says otherwise. If you offer plans, treat tenants in the same situation the same way.
How long should a rent payment plan last?
Short enough that the tenant can keep up with the regular rent and still clear the balance, often within a few months. A plan that runs too long can leave the balance growing instead of shrinking.
Can I charge a late fee during a payment plan?
Only what your lease and state law allow. Decide it up front and write it in the agreement: for example, no new late fees on plan payments made on time, or a late fee on a missed plan payment as the lease allows.
Does a payment plan stop an eviction?
A plan is an agreement between you and the tenant, not a court order. If you already served a notice or filed a case, accepting money can affect it in some states, such as Florida and California, so ask a local attorney first.
How do I record payment plan payments?
Give every payment its own ledger line with the date, amount and method, and note which plan payment it is, for example plan payment 2 of 3. Keep new rent charges on the same running balance.
Track every payment in one place. Our free rent ledger template keeps a running balance for each tenant, so a payment plan is easy to follow.
