Late Rent Notice: Free Template, Sample Letter and State Rules
A late rent notice (also called a late rent payment notice) is a written reminder that tells a tenant the rent was not received by the due date, how much is owed (including any late fee the lease allows), and how to pay. Send it the day after your grace period ends. It is not the same as a formal eviction notice, such as a 3 day notice to pay or quit, which has strict state rules. Below is a free fillable late rent notice template, a sample letter, and the formal notice rules for California, Texas, Florida and New York.

Late rent notice vs formal eviction notice
| Friendly late rent notice | Formal notice (pay or quit, rent demand) | |
|---|---|---|
| Purpose | Remind the tenant and keep a record | The legal first step before an eviction case |
| When | The day after the grace period ends | When you are ready to start the legal process |
| Format | Your own letter, email or text, if the lease allows | Strict state wording, timing and delivery rules |
| Risk if done wrong | Low | A mistake can force you to start over |
For most small landlords the friendly notice solves the problem. A tenant who forgot, or whose paycheck was late, usually pays within a few days. Keep the formal notice for when that does not work.
What should a late rent notice template include?
- Date of the notice
- Tenant name and the rental address, including the unit
- The rent period, for example the rent due on 11/01/2026
- Rent due, amount received so far and balance owed
- Any late fee, only if the lease and state law allow it
- How and where to pay, and a date you expect payment
- A friendly line inviting the tenant to contact you
- Your name and contact details

Change the names, amounts and payment details to match your lease. If the tenant paid part of the rent, show the amount received and the balance. Before you accept a partial payment, read our partial rent payment guide, because in some states accepting part of the rent can affect an eviction.
Formal notice rules in CA, TX, FL and NY
If the rent is still unpaid after your friendly notice, the next step is a formal notice. These are the basic rules in four large rental states. Always use your state or court’s official form when one exists.
| State | Formal notice before filing | Key details | Law |
|---|---|---|---|
| California | 3 day notice to pay rent or quit | Weekends and court holidays do not count in the 3 days | Code Civ. Proc. 1161 |
| Texas | 3 day written notice to vacate (or to pay rent or vacate) | Unless the lease sets a different period. SB 38 changes the eviction process for cases filed on or after 01/01/2026 | Prop. Code 24.005 |
| Florida | 3 day notice to pay rent or deliver possession | Weekends and legal holidays do not count in the 3 days | Fla. Stat. 83.56(3) |
| New York | Written 14 day rent demand | Separately, if rent is not received within 5 days of the due date, the landlord must send a written notice by certified mail before using nonpayment against the tenant | RPAPL 711, RPL 235-e |
Many cities add their own rules on top, especially in California and New York City. Check your city as well as your state. Late fee limits and grace periods for every state are in our 50-state late fee table.
Example timeline for rent due on the 1st
| Date | Step |
|---|---|
| 11/01 | Rent is due |
| 11/02 to 11/06 | Grace period (5 days in this lease) |
| 11/07 | Send the friendly late rent notice and add the late fee to the ledger |
| 11/10 | Payment date in the notice |
| 11/11 or later | If still unpaid, decide whether to serve the formal state notice |
How do you record it in your ledger?
- Add the late fee as its own charge line on the date it applied.
- Note the date the notice was sent and how (email, mail, certified mail).
- Keep a copy of the notice with the tenant’s records.
- When the tenant pays, record the payment with its date and method so the balance goes to zero.
Our free rent ledger template does this for you, and the tenant ledger view prints a clean history if a court or housing authority asks for it. Use the late fee calculator to check the fee first.
Notice rules change and many cities have their own requirements. Use your state’s official forms and ask a local attorney before you serve a formal notice or file an eviction.

For every Texas rule in one place, see our Texas landlord guide.

If the tenant can’t pay the full balance at once, a written rent payment plan agreement sets the amounts and dates for paying it off.

Frequently asked questions
When should I send a late rent notice?
The day after the grace period in your lease ends. If there is no grace period, the day after rent was due, unless your state requires a waiting period.
Can I send a late rent notice by email or text?
A friendly reminder can usually go by email or text if your lease allows it. Formal notices often have strict delivery rules, such as certified mail in New York, so check your state law.
Is a late rent notice the same as an eviction notice?
No. A friendly late notice is a reminder. A formal notice, such as a 3 day notice to pay or quit, is the legal first step of an eviction and has strict rules.
Can I add a late fee to the notice?
Yes, if your lease includes a late fee and it follows your state’s limits. Show the fee as a separate line.
What if the tenant pays part of the rent?
Record the payment and show the remaining balance. Check your state rules first, because accepting partial rent can affect an eviction in some states. A rent receipt for the partial payment gives the tenant proof of what was paid.
